Response to DMCA Notices

Upon receiving a valid DMCA notice, Thrivebot will take the following actions:

  • Remove or disable access to the allegedly "Infringing Material".
  • Notify the user who posted the material of the takedown and provide them with the opportunity to submit a counter-notice.
  • Document the notice and our response for compliance purposes.

Submitting a DMCA Counter-Notice

If you believe that your content was removed or disabled as a result of a mistake or misidentification, you may submit a DMCA counter-notice. Your counter-notice must include:

  • Your physical or electronic signature.
  • Identification of the material that was removed or disabled and its location before removal.
  • A statement, under penalty of perjury, that you have a good faith belief that the material was removed or disabled as a result of mistake or misidentification.
  • Your name, address, telephone number, and email address.
  • A statement that you consent to the jurisdiction of the federal court in your judicial district or, if outside the United States, to a U.S. court, and that you will accept service of process from the person who provided the original DMCA notice or their agent.

If a valid counter-notice is received, Thrivebot may restore the removed content within 10-14 business days unless the original complainant notifies us of a court action seeking to restrain the restoration.

Repeat Infringers

Thrivebot reserves the right to terminate accounts or access for users who are determined to be repeat infringers. A repeat infringer is a user who has been notified of infringing activity more than twice or has had content removed for infringement multiple times.
